Terms of Service

Husssle introduces people to each other. What happens next is between the two of you — here is what each side agrees to.

1. This agreement

These Terms are a contract between you and Husssle. By creating an account, posting a hustle, applying for one, or browsing as a guest, you accept them. If you do not accept them, do not use Husssle.

Our Privacy Policy forms part of these Terms and explains what we do with your data.

2. What Husssle is, and is not

Husssle is an introduction service. It lets a person photograph something that needs doing and lets people nearby offer to do it. That is the whole of what we provide.

Husssle is not a party to the work, the agreement or the payment. When a poster picks a worker, the contract for that job is formed between those two people. We are not in it. Specifically, Husssle is not:

  • an employer. Nobody on Husssle works for Husssle. There is no employment relationship, no contract of service, no wages, no supervision, no leave, no NSSF or SHIF contributions from us. Everyone using Husssle to work does so as an independent person on their own account.
  • an agency, a broker or a labour contractor. We do not assign jobs, allocate workers, take a margin, or hold anyone out as our representative.
  • a payment service. We never hold, transmit, escrow or refund your money. See Payment.
  • a guarantor of anyone. We do not employ, train, licence, insure, background-check or vet the people you meet through Husssle. Ratings and levels are records of what other users reported, not a certification by us.

You are responsible for deciding who you let into your home and whose work you accept, and for deciding whose job you take and whether the price is worth it. Use the ratings, ask questions, and walk away if something feels wrong.

You are also responsible for your own tax, licences and permits. If the work you do requires a licence in Kenya — some electrical, plumbing and gas work does — you must hold it. If your earnings are taxable, declaring them is your obligation, not ours.

3. Who may use it

  • You must be 18 or older.
  • You must have a working Kenyan mobile number, because that number is your login and your identity here.
  • Your details must be true. A real name, a real area, real skills.
  • One account per person. Multiple accounts are how people escape a bad rating, so they are not allowed.
  • You must not be using Husssle on behalf of someone who is suspended.

You may browse open hustles as a guest. An account is needed only to apply, to post, or to see your own jobs and profile.

4. Your account

Your account is personal to you and cannot be sold, rented, shared or transferred. Neither can your rating or your level — a record on Husssle means something only because it belongs to the person who earned it.

Keep control of the phone number and the SIM you registered with, because anyone holding it can receive your sign-in code. Tell us at support@husssle.app immediately if you lose the number or think someone else is using your account. You are responsible for what happens on your account until you do.

You can delete your account at any time: Profile → Settings → Delete my account, or via husssle.app/delete-account.

5. If you post a hustle

You agree to:

  • Describe the job honestly. The photo must be of the actual thing that needs doing, taken by you, and current. Do not post a photo of a tidy room for a job that is clearing a flooded store.
  • Post a price you will actually pay. The pay you enter is an offer. If the job turns out bigger than the photo showed, agree a new price with the worker before they carry on — do not let them finish and then renegotiate.
  • Pay promptly and in full when the work is done as agreed. On completion, that day, to the number of the person who did it.
  • Provide a safe place to work and be honest about anything hazardous — live wiring, a dangerous dog, a collapsing wall, a leaking gas cylinder. Warn people before they arrive, not after.
  • Turn up, or say you can’t. If you have picked someone and your plans change, tell them as early as you can. Somebody has kept their day free for you.
  • Not ask for free “trial” work, not ask anyone to buy materials out of their own pocket without agreeing it in writing first, and not ask for work that is illegal or unsafe.
  • Confirm or dispute completion. When a worker marks a job finished you should confirm it or raise a problem. A job you leave untouched auto-completes after 48 hours, because a poster who goes quiet must never be able to lock a worker out of earning. Auto-completion releases the worker’s capacity to take other jobs; it is not a statement by us that the work was good, and it does not affect your right to dispute the work directly with them.

6. If you do a hustle

You agree to:

  • Be honest about your skills. Apply for work you can actually do. If a job needs a qualification or a licence you don’t hold, don’t take it.
  • Show up. At the time agreed, at the place agreed. If something goes wrong and you cannot make it, tell the poster as early as possible — a message the night before is a problem, a silence on the morning is a betrayal.
  • Do the work to a reasonable standard, with reasonable care and skill, and finish it.
  • Bring what you said you would bring, and do not start work you know you cannot complete.
  • Respect the place you are working in and the people in it. Do not enter rooms you were not asked into, do not take photographs of someone’s home beyond what a job needs, and do not take anything that isn’t yours.
  • Charge what you agreed. Do not raise the price once you have started unless the job is genuinely different from what was posted, and then only by agreement before continuing.
  • Not send someone else in your place without telling the poster and getting their agreement. They chose you, on your record.
  • Mark the job finished honestly, when it is actually finished.

Your level sets how many jobs you may hold at once — New: one, Proven: two, Trusted: three. Do not take on more than you can genuinely deliver in the time you promised.

7. Payment

People pay each other directly on M-Pesa. Husssle takes nothing and holds nothing.

There is no commission, no service fee, no platform charge, and no wallet. Husssle is not an escrow agent and is not a payment service provider; we do not hold client funds and are not licensed to. Money never passes through us, which means:

  • The amount agreed between poster and worker is the amount that moves, in one direct transfer.
  • We cannot refund you, reverse a transfer, or release a payment, because we never had it.
  • If a poster does not pay, that is a debt owed to the worker by that person. We will show what the record says — what was posted, what was agreed, when it was marked complete — and that record is often enough to settle it. We will act on the account of someone who repeatedly does not pay. But recovering the money is a matter between the two of you, and if necessary through the Kenyan courts.
  • Standard M-Pesa transaction charges are set by Safaricom, not by us, and are paid by whoever the M-Pesa tariff says pays them.

Never pay in advance for work that has not been done, and never pay anyone a fee to be allowed to work on Husssle. Nobody legitimate will ask.

If we ever introduce an optional paid feature — for example a subscription for workers — it will be clearly priced, opt-in, and it will still not put us between you and the money for a job.

8. Prohibited conduct

Any of the following can get your account suspended or removed, and where a crime has been committed we will report it.

Fake and dishonest listings

  • Posting a job that does not exist, or that you have no intention of paying for.
  • Using a photo that is not of the actual work — a stock image, someone else’s photo, an old photo of a different problem.
  • Posting the same job many times to occupy the feed, or posting adverts, recruitment, sales, promotions or anything that is not a specific piece of work to be done.
  • Posting on behalf of a business while pretending to be an individual, or the reverse.

Advance-fee and payment scams

  • Asking a worker to pay anything — a “registration fee”, a “deposit”, “transport money”, a “tools bond”, a fee to be shortlisted — before or in order to get work. This is the most common scam in this market and it is an instant ban.
  • Asking a poster to send money before any work has been done, other than a genuine, agreed materials cost.
  • Sending a fake M-Pesa confirmation message, or a screenshot of a payment you did not make.
  • Trying to take a person off Husssle in order to run any of the above.

Harassment and abuse

  • Threats, intimidation, stalking, or repeated contact after someone has asked you to stop.
  • Sexual advances, sexual content, or using a job posting as a pretext to meet someone.
  • Insults, slurs, or abusive language, in the app or in the call and WhatsApp contact that follows.
  • Using someone’s phone number, revealed to you for a job, for anything other than that job.

Discrimination

  • Refusing, excluding or mistreating anyone on the grounds of ethnicity, tribe, race, sex, pregnancy, marital status, health status, disability, religion, conscience, belief, culture, dress, language or birth — the grounds protected by Article 27 of the Constitution of Kenya — or writing a job post that expresses such a preference.

Dishonesty about identity, and gaming the system

  • Impersonating someone else, or using another person’s number, name or photograph.
  • Holding more than one account, or making a new one after being suspended.
  • Writing, buying, trading or arranging reviews; reviewing yourself through a second account; threatening a bad review to obtain free work or a discount.
  • Scraping the app or site, automating access, reverse-engineering it, attacking it, or attempting to reach data that is not yours.

Illegal and unsafe work

  • Anything unlawful in Kenya; work involving weapons, drugs or stolen property; work that requires a licence you do not hold; or asking a person to do something that would put them in serious danger.
  • Involving anyone under 18 in work arranged through Husssle.

9. Photos and content you upload

You keep ownership of your photos and your words. You give Husssle a non-exclusive, worldwide, royalty-free licence to host, store, resize and display them for the purpose of running the service — showing your job in the feed, on a job page, and in the app. That licence ends when you delete the content or your account, apart from copies sitting in backups until they cycle out.

You promise that you took the photo or have the right to use it, that it shows the actual work, and that posting it does not breach anyone’s rights. Do not photograph other people without their agreement, and do not photograph documents, screens, keys, security arrangements or anything else you would not put on a public noticeboard — job photos are visible to anyone browsing.

We may remove content that breaks these Terms, and we may remove a job that has been reported while we look at it.

10. Reviews and levels

Reviews are the reason this works, so we treat them seriously.

  • Both sides review. After each job the poster rates the worker and the worker rates the poster.
  • One review per job, from first-hand experience of that job, and honest.
  • You must review your last job before applying for a new one. This is what keeps ratings current instead of sparse.
  • We do not delete a review for being negative. A bad review that is true is exactly what the system is for, and no amount of asking will get it removed.
  • We do remove reviews that are abusive, contain someone’s personal data, have nothing to do with the job, were traded or bought, or were extracted by threat.
  • Levels — New, Proven, Trusted — are calculated from finished jobs and your average rating, and control how many jobs you may hold at once. A level drops only when your average falls below 4, never on the strength of one bad review. If you think a level is wrong, write to us and a person will look at it.

11. Reports, suspension and termination

Any job or any user can be reported from inside the app, and you can block someone so that their posts no longer appear in your feed. Blocking is a filter on what you see; it does not by itself stop the other person applying to a job you post, so where somebody has behaved badly you should report them as well — that is what leads to a suspension. We aim to review every report within 24 hours. The person you report is not told who reported them.

Depending on what we find we may do nothing, remove content, warn, restrict, suspend, or permanently remove an account. We will act immediately and without warning where there is a risk to someone’s safety, a scam in progress, or a clear crime.

If your account is suspended you can appeal by emailing support@husssle.app, and a person — not an automated system — will read it.

You may stop using Husssle and delete your account at any time. Sections that by their nature should survive — payment obligations already owed to another user, content licences for copies in backups, liability, indemnity and governing law — survive termination.

We may also stop offering the service, or any part of it, and will give reasonable notice in the app if we do.

12. Safety

Husssle puts two strangers in contact. Please take that seriously:

  • Agree the price, the scope and the time before anyone travels.
  • Read the ratings and the reviews. A thin record is not a red flag on its own — everyone starts at New — but a pattern of complaints is.
  • Tell someone where you are going, and when you expect to be finished.
  • Do not pay in advance. Do not accept a job that requires you to pay to start.
  • Stop work and leave if a place or a person is not safe. No job is worth an injury.
  • In an emergency call 999 or 112. Then tell us, so we can act on the account.

13. Liability

Husssle is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or that you will find work or find a worker.

Because we are only the introduction, and to the fullest extent permitted by Kenyan law, we are not liable for:

  • the quality, timeliness, safety or legality of any work done or not done;
  • a worker who does not arrive, or a poster who does not pay;
  • damage to property, loss of items, or injury arising from a job;
  • the truthfulness of anything a user tells you, including their skills, their identity or their photographs;
  • anything that happens once you leave the app — the calls, the WhatsApp messages, the M-Pesa transfer, the visit itself;
  • indirect, incidental, special or consequential loss, or loss of profit, income, goodwill or data.

Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims connected with Husssle is limited to the greater of KES 5,000 or the total fees you have paid us in the twelve months before the claim — which, since we charge nothing, is currently nil.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited under Kenyan law. Nothing here removes any right you have as a consumer under the Consumer Protection Act, 2012.

14. Indemnity

You agree to indemnify Husssle against claims, losses and reasonable costs arising from your breach of these Terms, from the work you do or commission through Husssle, or from content you post. This does not apply to the extent the claim arises from our own negligence or breach.

15. Governing law and disputes

These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.

A dispute between two users about a job is theirs to resolve; Husssle is not an arbitrator and cannot order anyone to pay or to redo work. We will provide the record of what was posted and agreed, and we will act on accounts that behave badly.

If you have a dispute with us, please write to support@husssle.app first. We would rather fix it than litigate it, and most things are resolved within a few days.

16. Changes to these Terms

We may update these Terms as the service changes or as the law requires. The version and date at the top always show the current one.

For material changes we will give notice in the app at least 14 days before they take effect. Continuing to use Husssle after that date means you accept the new Terms; if you do not accept them, delete your account, and any change will not apply retroactively to a job already agreed.

17. General

  • These Terms and the Privacy Policy are the whole agreement between us about Husssle.
  • If any part of them is found unenforceable, the rest stays in force.
  • If we do not enforce something immediately, we have not waived it.
  • You may not transfer your rights under these Terms. We may transfer ours to a successor of the business, and your rights will not be reduced by that.
  • Nothing here creates a partnership, joint venture, agency or employment relationship between you and us.
